Re: Nash County, NC has a proposed Animal Control Ordinance

Nash county did not have it on their web site, I went and got a copy.

Seems like there could be some back door regulation on hunting dogs.

Section 4-7. Aminals at Large

A. It shall be unlawful for any owner or keeper to permit an animal to be at large. Animal Control Section shall confiscate any animal found to be at large and impound it at the Nash County Animal Shelter in accordance with the provisions of this ordinance.

B. An owner may lawfully permit an animal which is not dangerous to be at large in the course of a show, obedience school, tracking test, field trialing, or other events sanctioned or supervised by a recognized organization. Hunting dogs may be at large in the course of lawful hunting if under the control of the owner. However, this provision does not exempt the an owner from otherwise complying with Section 4-8 or any other provision of this Ordinance.

Section 4-8. Animals Creating Nuisance

A. It shall be unlawful for any person to own, keep, posses or maintain an animal in such a manner so as to constitute a nuisance.

B. The actions of an animal constitute a nuisance when an animal disturbs the rights of, threatens the safety of, or damages a memeber of the general public; or interferes with the ordinary use and enjoyment of private or public property. By the way of example and not of limitation, the following acts or actions by an owner or keeper of an animal are hereby declared to be a nuisance and are therefore unlawful:
1. Allowing an animal that habitually or repeatedly disturbs, interferes with or annoys human beings in a manner that is inconsistent with responsible ownership of such an animal.

Section 4-20 Imposition of Penalties for violations of Ordinance

A. The violation of any provision of this article shall be a Class III misedemeanor and any person convicted of such a violation shall be punished in accordance with this ordinace. Each day's violation of this article is a seperate offense. Payment of a fine in the criminal proceedings pursuant to this subsection does not relieve a person of his liability for fees or citations imposed under this ordinance.

I could not get the scans of the proposal to post here, so this is just some parts of it I typed. There is no exception for hunting dogs having collars with rabies vaccination tag on it, but is for other functions. This may be an oversight but who knows.

I will try to scan the entire do***ent tomorrow and could e-mail any one who wants it.

What do ya'll think am I over reacting or not?
